01 Acceptance of terms
These Terms and Conditions (“Terms”) govern your use of the PoseUP mobile application (“PoseUP”, “the App”) operated by Oblix Apps LLC (“we”, “us”, or “our”).
By downloading, installing, or using PoseUP, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
02 Description of service
PoseUP is a pose reference and camera overlay app. It lets you browse a library of poses, scan your location for scene-matched suggestions, and use a ghost guide overlay in your camera to help you recreate poses when taking photos.
We may update, modify, or discontinue features at any time. We do not guarantee uninterrupted or error-free operation.
03 Subscription terms
Free tier. PoseUP offers a free version with access to a limited set of features and poses. Free tier limitations may change over time. We will always clearly indicate which features require a PRO subscription.
PoseUP PRO. PRO is an optional paid subscription that unlocks additional poses, features, and content. PRO subscriptions are billed through the Apple App Store (or Google Play when the Android version is available).
- Billing cycle. PRO is available as an auto-renewing subscription (for example, monthly or yearly, as shown in the App Store at the time of purchase).
- Auto-renewal. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
- How to cancel. You can manage or cancel your subscription at any time through your device settings: Settings → [your name] → Subscriptions → PoseUP → Cancel Subscription. Deleting the app does not cancel your subscription.
- Price changes. Subscription prices may change. Apple will notify you of any price increase in advance, and you may accept or cancel before the new price takes effect.
- Refunds. All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with Apple’s refund policy. See reportaproblem.apple.com or Apple Support for details. Oblix Apps LLC does not process refunds directly for App Store purchases.
04 User conduct
You agree to use PoseUP lawfully and responsibly. You must not:
- Use the App for any illegal purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or extract source code from the App
- Scrape, bulk-download, or redistribute pose library content outside the App
- Interfere with or disrupt the App, servers, or networks
- Use the App to harass, exploit, or harm others
- Misrepresent your affiliation with Oblix Apps LLC or PoseUP
We reserve the right to restrict access if you violate these rules.
05 Intellectual property
- Pose library content. Pose reference images, illustrations, UI design, branding, and other content provided in PoseUP are owned by Oblix Apps LLC or licensed to us. You receive a limited, personal, non-exclusive, non-transferable license to view and use this content within the App for your own photography purposes.
- Your photos. Photos and content you capture using PoseUP remain your property. We do not claim ownership of your personal images.
- Restrictions. You may not copy, redistribute, resell, sublicense, or publicly republish pose library content outside the App. You may not use PoseUP content to train AI models or create competing pose libraries without our written permission.
- Trademarks. “PoseUP”, the PoseUP logo, and related marks are the property of Oblix Apps LLC. You may not use our trademarks without prior written consent.
06 Camera and photos
PoseUP requires camera access to display the pose overlay. The camera feed is processed on your device. We do not upload your live camera feed or personal photos to our servers during normal use.
You are solely responsible for the content you capture, including ensuring you have permission to photograph people and locations, and for complying with local laws regarding photography and privacy.
Saving photos to your device or photo library is controlled by you through your device’s permissions and settings.
07 Disclaimer of warranties
PoseUP is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, secure, or free of errors, or that pose suggestions will produce any particular photographic result.
08 Limitation of liability
To the maximum extent permitted by applicable law, Oblix Apps LLC and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use PoseUP.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us for PoseUP PRO in the twelve (12) months preceding the claim, or USD $50 if you use the free tier.
Some jurisdictions do not allow certain limitations of liability. In those cases, our liability is limited to the fullest extent permitted by law.
09 Termination
You may stop using PoseUP at any time by uninstalling the App and canceling any active subscription through the App Store.
We may suspend or terminate your access to PoseUP immediately if you breach these Terms, if required by law, or if we discontinue the App. Upon termination, your right to use the App ends. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
10 Changes to terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Material changes may be communicated through the App or other reasonable means. Your continued use of PoseUP after updated Terms take effect constitutes acceptance of the changes.
11 Governing law
These Terms are governed by the laws of Romania, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.
If you are a consumer in the European Union, you also benefit from mandatory provisions of the law of your country of residence. Nothing in these Terms affects your statutory rights as a consumer under EU law.
Any disputes arising from these Terms or your use of PoseUP shall be subject to the exclusive jurisdiction of the competent courts in Romania, unless applicable consumer law grants you the right to bring proceedings in your country of residence.
